Noctoptics Inc. ("Noctoptics", "we", "us") operates noctoptics.com and supplies security, parking and access control equipment to installers, integrators and property managers across Canada. This policy explains what personal information we collect, why we collect it, who we share it with and the choices you have. It is written to meet the Personal Information Protection and Electronic Documents Act (PIPEDA) and Québec's Act respecting the protection of personal information in the private sector, as amended by Law 25.

What we collect

  • Contact and business details — name, company, job title, email address, phone number, and billing and shipping addresses, when you create an account, apply for a dealer account, request a quote or consultation, or contact us.
  • Account credentials — the email address and password you choose for your account.
  • Order and payment information — products ordered, order history, invoices and payment status. Card payments are processed by our payment processors; we do not store full card numbers.
  • Communications — the content of emails, forms, calls, and support or warranty (RMA) requests you send us.
  • Technical and usage information — IP address, browser and device type, pages visited and referring pages, collected through the cookies and similar technologies described below.

Why we use it

  • To process and deliver orders, issue invoices, and manage returns and warranty claims.
  • To review dealer account applications, apply dealer pricing and payment terms, and manage your account.
  • To respond to quote and consultation requests and support your projects.
  • To send service messages about your account, your orders or product safety notices.
  • To send marketing emails about products and promotions, only where you have given consent in line with Canada's Anti-Spam Legislation. You can unsubscribe at any time using the link in any email.
  • To secure our website and accounts, prevent fraud and comply with legal obligations.

We collect only the information needed for these purposes, and we do not sell personal information.

Who we share it with

We share personal information only with service providers that need it to do work for us, under contracts that restrict how they may use it:

  • Shopify, which hosts our store and processes accounts and orders;
  • payment processors, to take payment;
  • shipping carriers, to deliver orders;
  • the software we use for dealer accounts, email communications, customer support and website analytics.

We may also disclose information when required by law, to protect our rights, or as part of a business transaction such as a merger or sale, in which case this policy continues to apply to the information transferred.

Transfers outside Québec and Canada

Some of our service providers, including Shopify, store or process information on servers located outside Québec and outside Canada, principally in the United States. Before using such a provider, we assess whether the information will receive adequate protection and we rely on contractual safeguards. By using our services, you acknowledge that your information may be processed in these jurisdictions, where privacy laws may differ from those of Québec.

Cookies and similar technologies

Our website uses cookies to keep you signed in, remember your cart and language, measure how the site is used and, where you consent, support marketing. Essential cookies are required for the site to function. Analytics and marketing cookies are used only with your consent, which you can give or withdraw through the cookie settings on our site or in your browser. Refusing non-essential cookies does not prevent you from browsing or ordering.

How long we keep it

We keep personal information for as long as needed for the purposes above and to meet our legal obligations. Order and invoice records are retained for the period required by Canadian and Québec tax law. Account information is kept while your account is active and for a reasonable period after it is closed. Information that is no longer needed is deleted or anonymized.

How we protect it

We use administrative, technical and physical safeguards appropriate to the sensitivity of the information, including access controls, encryption in transit and the security measures of our hosting platform. No system is completely secure, so we encourage you to use a strong, unique password and to contact us if you suspect unauthorized access to your account. If a confidentiality incident presents a risk of serious injury, we will notify the Commission d'accès à l'information du Québec and the individuals concerned, as the law requires.

Your rights

Subject to applicable law, you may:

  • ask for access to the personal information we hold about you;
  • ask us to correct information that is inaccurate or incomplete;
  • withdraw your consent to marketing or to non-essential cookies at any time;
  • ask us to delete information we no longer need, or to stop using it, subject to our legal retention obligations;
  • ask for a copy of the information you provided to us in a structured, commonly used format.

To exercise these rights, contact our Privacy Officer at the address above. We will respond within 30 days. If you are not satisfied with our response, you may file a complaint with the Commission d'accès à l'information du Québec or the Office of the Privacy Commissioner of Canada.

Children

Our products and services are intended for businesses and are not directed at minors. We do not knowingly collect personal information from anyone under 14. If you believe a minor has provided us with personal information, contact us and we will delete it.

Changes to this policy

We may update this policy as our practices or the law change. The date at the top shows the latest revision. Significant changes will be announced on this page, or by email to account holders, before they take effect.
